TERMS AND CONDITIONS

Welcome to Denny Igoe Typography, dba Denny Igoe Graphic Design. By using our Website you agree to be bound by the terms and conditions set forth below, and our Privacy Policy and all disclaimers or other terms and conditions that appear elsewhere on our Website (collectively the "Agreement"). Your use of our Website constitutes your agreement to follow and be bound by the Agreement. If you do not agree to be bound by the Agreement, please do not use our Website. Although you may "bookmark" a particular portion of our Website and thereby bypass the Agreement, your use of (or clicking onto) any portion or page of our Website still binds you to the Agreement. Since we may revise the Agreement at any time, we recommend that you visit these pages periodically to review the Agreement.

General Information

Any original media (discs, pictures, slides, proofs, etc.) are non-returnable and become our property unless pre-arrangements are made. If client provides any artwork (final art for printing or logos to be used by us), the preferred file type is hi-resolution Adobe PDF, with fonts embedded or outlined. Acceptable applications (software) for Mac are (but not limited to) Adobe InDesign, Adobe Illustrator, Adobe Photoshop (best for client-supplied photos) and Adobe PDF. Additional charges may apply if furnished media are incompatible with our software. We cannot guarantee consistent results if files are generated by other applications such as Microsoft Publisher or Word documents. For best results, all rasterized files should be converted to CYMK and at least 300dpi. Denny Igoe Graphic Design or its suppliers are not responsible for images printed as fuzzy, distorted or pixilated due to client-provided artwork or for color shifts that occur in conversions from RGB to CMYK format. All fonts must be included in a separate folder or embedded in the print file. All graphic images must be included in a separate folder or embedded in the print file. Images must be flattened with CMYK in TIFF or EPS format. Turnaround time begins after receipt of final proof approval. Additional charges may apply if fonts and/or graphics are missing or if such fonts or graphics require repair or digital enhancement/corrections to complete the job. Final approval will only be accepted in written format, such as an e-mail or fax. No verbal approvals will be accepted. Printing job is considered complete if within +/- 5% of ordered quantity.

Price Quotations

Please check the description of items carefully on quote sheet(s). Quote is based on specific instructions given us. If there is a material change in design, production specifications and/or printing, this may affect a change in pricing and turnaround. The responsibility is yours to provide us with timely and accurate information for quote. Any changes made by you in specifications, layout, design, etc. is chargeable and may increase initial price quote. Quoted prices may not include any shipping, handling or sales taxes (if applicable). Prices subject to change without notice. There are no conditions or agreements relating to the order which are not written and itemized in the Quotation or accompanying said order. All prices are in U.S. Dollars. Written estimates are good for 30 days. An estimate not accepted within 30 days may be changed.

Deposits

Design: All design jobs quoted at less than $100 must be paid in full, U.S. Dollars, in advance of work commencing. All design jobs over $100 require a 50% deposit in advance of work commencing; with the balance to be paid in full prior to final delivery of design and/or artwork. All design and/or artwork remain the property of Denny Igoe Graphic Design until paid in full by client. We accept Visa, Mastercard and Discovery credit cards, as well as personal check and cash.

Printing & Buyout Brokerage (Outside Suppliers): All printing and outside suppliers must be paid in full at the time of ordering.

Proofs

Please carefully check spelling, address(es), e-mail(s), web address(es), phone numbers, etc. for accuracy. We will correct any errors you bring to our attention; however, we are not responsible for errors in the final art or printing if such errors are the result of you forwarding to us incorrect spelling, address(es), e-mail(s), web address(es), phone numbers, etc.

Color Proof Accuracy

Please note that color proofs supplied to you in a pdf format or an inkjet hardcopy print-out cannot match the final printed product 100%. This is due to the fact that proofs are created in a different way than the printed piece (i.e. your computer's screen quality, inkjet dye inks vs. printer's ink, paper stock, registration, line screens, etc.). Also note that a proof from your own printer may not closely match our proofs or the printed piece for the same reasons, and because the client-printed proofs are not calibrated to commercial presses.

Turnaround & Delivery Time

Although we make every possible effort to turn jobs around in the estimated times offered, your job may require more time due to unforeseeable or uncontrollable circumstances or finishing services added onto the job. We will not credit clients if a job runs past the estimated turnaround time. TURNAROUND TIMES ARE AN ESTIMATE, NOT A GUARANTEE! We will always act to make sure that any production difficulties do not delay delivery schedules. In no case shall Denny Igoe Graphic Design be liable for any consequential or damages resulting from any delay in shipment or delivery.

PRINT & BUYOUT BROKERAGE: All Denny Igoe Graphic Design clients agree not to hold Denny Igoe Graphic Design liable for delays in shipments caused by print vendors and outside suppliers, weather conditions, shipping company delays, international customs issues or any other circumstances beyond our direct control. Our shipment and delivery dates are calculated based upon estimates provided by our suppliers.

Unexpected equipment failure, malfunction and/or technical problems may delay the printing process. In case of delay caused by technical difficulty, rush charges/fees will be refunded or waived where applicable. However, technical difficulty will not be the grounds for order cancellation.

Order Cancellation and Refund Policy

Cancellation: Orders that are cancelled are subject to fees incurred (graphic design hourly rates; administration costs including credit card fees) based on the current production status of your job and will be subtracted from your refund. Minimum cancellation fee is $15.00 U.S. Dollars.

Refund: Since each order is unique to client and has no re-sale value, All Design, Printing, and outside supplier Sales Are Final. If we verify that we made an error in printing or purchasing outside supplies, we will re-print the order. No Refunds or Credit. Client must notify Denny Igoe Graphic Design within 5 business days of accepting printing or outside supplies to notify any defects discovered in the ordered product(s). In order to receive replacement, client must return 100% of the received product within 14 days (on their own expense) from the time when the ordered product's delivery was taken.

All charges related to expedite printing or buyouts (Rush Printing or Shipping) are NOT REFUNDABLE, including for those orders that are returned for any reason. All orders that are being returned must be shipped by customer's own expense.

Privacy Policy

Any information Denny Igoe Graphic Design collects from order processing or from any inquiries is not shared with any other company. Your information is only used for contact, billing, and shipping purposes. Your credit card information is never stored by us.

Denny Igoe Graphic Design may use your product for samples or advertising purposes, unless notified in writing of its inability to do so. In the event of a written notice, Denny Igoe Graphic Design will cease its usage of your product within 30 days of receipt of the notice. Any usage of the product for samples or advertising purposes prior to the receipt of the written notice will be deemed as acceptable.

Right Of Refusal

We reserve the right to refuse service or products to any person or organization.

Denny Igoe Graphic Design may change, modify, add or remove portions of this policy at any time, and any changes will become effective immediately upon being posted unless stated otherwise. This policy was last revised on February 15, 2012.
